1. Who we are
MyAdvisors Pty Ltd, trading as Taxminds (Taxminds, we, us or our), provides tax and related professional services. We are committed to handling personal information responsibly and in accordance with applicable Australian privacy requirements, including the Privacy Act 1988 (Cth), the Australian Privacy Principles and the Privacy (Tax File Number) Rule 2015 where applicable.
2. Information we may collect
Depending on the service, we may collect identification and contact details; date of birth; tax file number; Australian Business Number; income, deduction, asset, liability, banking and payment information; employment, business, investment and property records; residency and family information relevant to tax obligations; government identifiers; correspondence; identity-verification information; and information about how you use our services.
We seek to collect only information reasonably necessary for our functions and professional obligations. If you provide information about another person, you should be authorised to do so and, where appropriate, make them aware of this policy.
3. How we collect information
We may collect information directly from you through engagement documents, secure questionnaires, meetings, telephone calls and correspondence. With your authority or where permitted by law, we may also obtain information from the Australian Taxation Office, other government bodies, financial institutions, employers, accountants, advisers, software providers and other third parties relevant to your matter.
4. Public website and email safety
This public website provides information and links only. It does not ask you to enter tax file numbers, identity documents, bank details or tax records. Please do not send sensitive personal or tax information through ordinary email. After engagement, we provide instructions for using approved secure systems.
5. Why we use personal information
Taxminds collects this information to identify you, establish and maintain your client record, prepare and provide taxation services, communicate with you and, where authorised, deal with the Australian Taxation Office and other relevant authorities on your behalf. Please ensure the information you provide is accurate and current.
We may also use personal information to obtain payment; meet record-keeping, professional, legal, regulatory, insurance and risk-management obligations; maintain and secure our systems; prevent fraud and security incidents; and manage complaints or disputes.
Updates, offers and client benefits: Taxminds and MyAdvisors Pty Ltd may send tax updates, reminders, service information, special offers and information about relevant products, services or benefits involving associated businesses, service providers or selected business partners, where permitted. You can unsubscribe at any time. We will not transfer your personal details to a business partner without separate consent, and tax-return-sensitive information will not be used to target marketing.
6. When information may be disclosed
We may disclose relevant information to the Australian Taxation Office and other government authorities; identity-verification providers; professional advisers and insurers; payment, accounting, document-signing, client-workflow, cloud, communications and technology providers; contractors assisting us under appropriate confidentiality and security arrangements; and other parties authorised by you or required or permitted by law.
Our current workflow may use providers such as Microsoft 365, Adobe Sign, ClientRelay, LodgeIT and QuickBooks. The providers used may change as our systems develop. Each provider handles information under its own terms, privacy arrangements and service locations.
7. Overseas access and processing
Some service providers may store or process information outside Australia. Subject to the engagement and work arrangements in place, authorised support personnel or service providers may also access information from India or the Philippines. Cloud and technology providers may process information in Australia, the United States and other locations disclosed in their current service documentation.
Where required, we take reasonable steps appropriate to the circumstances to ensure overseas handling is consistent with applicable Australian privacy obligations. Service locations can change, so please contact us if you require current information relevant to your engagement.
8. Tax file numbers and government identifiers
We handle tax file number information only for lawful taxation, assistance or related purposes. We do not use a government identifier as our own client identifier unless permitted by law. TFNs and identity documents should be provided only through the secure method we specify.
9. Security
We use administrative, technical and physical safeguards appropriate to the information and our operations. These may include access controls, multi-factor authentication, secure client systems, role-based access, logging, backups, staff or contractor confidentiality requirements and incident-response procedures. No electronic system is completely risk-free, and clients should promptly tell us about suspected unauthorised access or incorrectly addressed communications.
10. Retention and deletion
Tax and engagement records are generally retained for at least five years, and may be kept longer where taxation, professional, legal, insurance or other record-keeping obligations require it. When information is no longer required, we take reasonable steps to securely destroy it or de-identify it, unless continued retention is required or permitted by law.
11. Access and correction
You may request access to personal information we hold about you or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. We may need to verify your identity and may refuse or limit access where permitted by law. If so, we will generally explain the reason and available complaint options.
12. Data breaches
We assess suspected data breaches and take containment and remedial action. Where the Notifiable Data Breaches scheme applies and a breach is likely to result in serious harm, we will make the required notifications to affected individuals and the Office of the Australian Information Commissioner.
13. Cookies and website information
Our website host may process basic technical information needed to deliver and protect the website, such as IP address, browser type, request time and security logs. If analytics or advertising technologies are introduced, this policy and any required notices or choices will be updated before their use.
